A background check is a report of criminal history, and it is usually assembled from public record information. An employer may run a background check if they have intentions of hiring you, or if they decide to provide other employment benefits like a job promotion or granting of a higher security clearance. These background checks include instances of misconduct reported by other employers, as well as other criminal records that you may have. The information that is in these public records is stored inside a database, and it comes from government records.
Like other consumer reports, these are subject to the Fair Credit Reporting Act. The FCRA guarantees consumers certain rights when companies issue background reports in association with an employment decision. It requires that all background reporting companies must follow reasonable procedures to ensure the maximum possible accuracy of these reports.
The background check companies must also give you a copy of your consumer report on request once a year, for free. If there are any inaccuracies on these reports and there is a dispute, the background check companies must do a reasonable investigation to ensure the accuracy of what’s being reported.
